Prenuptial Agreements - Can they be rebutted?

Prenuptial agreements are created prior to marriage and are intended to protect individuals' assets they had prior to marriage in the event of a divorce. In order for a prenuptial agreement to be valid, both parties must completely disclose all financial information, including IRA's, real estate property, pensions, annuities, investments, and other property. Problems arise in prenuptial agreements when a party is not completely honest when disclosing information.

Our divorce settlement lawyers are skilled in presenting information to weaken prenuptial agreements in order to invalidate all or part of the agreement. Because the individuals do not have access to the other party's assets prior to marriage, a prenuptial agreement is very difficult to enforce.

Postnuptial Agreements - How can I enforce or rebut it?

Postnuptial agreements are created after individuals are married and are intended to protect assets and investments such as a new inheritance. Similar to a prenuptial agreement, there must be a full disclosure of assets in an agreement and the agreement must be fair to both parties. However, because the individuals are married, both parties should have more access and knowledge of the other's financial information. Therefore, postnuptial agreements are more commonly enforced than prenuptial agreements.
