The issues of child visitation is very similar to child custody. After a divorce or relationship ends, the parents of a child can be so emotionally charged that they see nothing but the worst aspects of the other parent. Every parent has a right to visitation with their child---more specifically, every child has a right to visitation with their parent. Because of this, a custodial parent cannot deny a parent or child's right to visitation with a non-custodial parent because of missed child support or alimony payments. Under extreme cases, the State of Florida will simply require supervised visitation. However, the first step in enforcing visitation with your child is setting up a court-ordered visitation agreement.

Enforceable Court Orders

A court-ordered visitation agreement will be fully enforceable through contempt hearings so that a parent can be assured he or she get equal parenting time. If you are a non-custodial parent who sees your child often enough, you may be entitled to a substantial reduction in monthly child support payments because of the expenses incurred in caring for your child during visitation. A post-divorce modification of the child support payments may become necessary to reflect the change in the visitation agreement.

Parental Relocation

A custodial parents is generally prohibited from moving out of the state with their child. However, prohibited parental relocations do take place. If this has occurred, our office can take steps to force an a parent to return to their home state until their have received permission to leave by a court.
